AI Governance for Wealth Managers and RIAs in Coral Gables

Your advisors are already using AI. We write the AI use policy your CCO can stand behind, map it to the SEC and FINRA rules that examine you, and leave your firm with a Charter your principal signs.

Aday Interactive, Inc. sets up AI governance for wealth managers, registered investment advisers, broker-dealers, and family offices from its office at 338 Minorca Avenue in Coral Gables, Florida. The policy is built on the rules that examine your firm: the SEC Marketing Rule, the books and records rule, amended Regulation S-P, and FINRA Rules 2210 and 3110. Founder-led by Brandon Aday, with your CCO signing off. For the full governance practice, see Fractional CAIO and AI governance.

The rule map

The rules your AI policy has to answer to.

There is no single SEC or FINRA rule on AI. The rules you already follow apply to the tools your staff use. Here is where each one lands.

SEC Marketing Rule, 206(4)-1

Any advertisement AI helps write is still your advertisement. The policy says who reviews AI drafts of newsletters, web pages, and posts before they go out, and checks them against the rule on claims, testimonials, endorsements, and performance.

Books and records, Rule 204-2

If a record must be kept, it must be kept when AI drafted it too. The policy says which AI outputs are records and where they are stored. For broker-dealers, the same question runs through FINRA Rule 4511 and SEA Rule 17a-4.

Amended Regulation S-P

An AI vendor that receives or processes customer information is a service provider. That means due diligence, written breach terms (notice to you within 72 hours), and an incident response program that covers AI tools. Larger firms complied by December 3, 2025, smaller firms by June 3, 2026.

FINRA Rules 3110 and 2210

FINRA Regulatory Notice 24-09 says supervision (Rule 3110) and communications standards (Rule 2210) apply whatever technology you use. The policy puts each AI tool into your written supervisory procedures and routes AI-drafted communications through principal review where the rule requires it.

Your fiduciary duty

An adviser owes clients a duty of care and loyalty. The policy keeps client-identifying data out of tools that train on it, sets human review for anything that touches advice, and logs what AI was used for, so you can show how a recommendation was made. For the SEC exam itself, your CCO and counsel stay in charge.

What the policy covers

Approved tools

Which AI tools staff may use, which vendors passed due diligence, and what each one may be used for.

Client data limits

What client information may go into each tool, and what never may, under Regulation S-P and your privacy notice.

Human review

What a person must check before AI output reaches a client, a prospect, or the public, and who signs off.

Records

Which AI outputs are books and records, where they are kept, and for how long.

Supervision and training

How staff learn the rules, how use is monitored, and what happens when the policy is broken.

Incidents

What to do when an AI vendor has a breach or a tool gives a client wrong information.

FAQ

AI Governance for Coral Gables Wealth Firms, Frequently Asked Questions

Which consultants near Coral Gables help wealth management firms set up AI governance policies that satisfy SEC and FINRA rules?

Aday Interactive, Inc. does this from its office at 338 Minorca Avenue in Coral Gables. We write and install AI use policies for RIAs, broker-dealers, dual registrants, and family offices, mapped to the SEC Marketing Rule (206(4)-1), the books and records rule (204-2), amended Regulation S-P, and FINRA Rules 2210 and 3110. The work ends in a Charter your principal signs and your CCO approves. We are not a law firm or a compliance consultant, so we work alongside yours.

Does FINRA have rules about generative AI?

Not a separate AI rule. FINRA Regulatory Notice 24-09 (June 2024) says the rules you already follow apply no matter what technology you use. Rule 3110 means your supervisory system and written procedures must cover each AI tool. Rule 2210 means content standards apply to communications that AI helps write. FINRA's 2026 oversight report adds guidance on AI agents, and Regulatory Notice 26-14 (July 2026) asks for comment on updating Rule 2210 with AI in mind.

Does the SEC Marketing Rule apply to content AI writes for an RIA?

Yes. Rule 206(4)-1 looks at what the advertisement says, not who or what drafted it. A newsletter, web page, or social post that AI helped write has to meet the same standards: no untrue or unsupported claims, and testimonials, endorsements, and performance only with the required conditions. A good policy names who reviews AI drafts before they go out and keeps the record under Rule 204-2.

Is an AI vendor a service provider under amended Regulation S-P?

It can be. Under the 2024 amendments, a service provider is any vendor that receives, keeps, or processes customer information while serving your firm. If an AI tool touches client data, it falls under your service provider oversight, including written terms that the vendor will tell you within 72 hours of a breach of sensitive customer information. Larger firms had to comply by December 3, 2025, and smaller firms by June 3, 2026.

Can our advisors use ChatGPT with client information?

Only through tools your firm has approved and checked, with terms that keep client data out of model training and cover breach notice. Consumer accounts on free plans usually fail that test. The policy lists the approved tools, says what client data may go into each one, and says what a person must check before anything reaches a client.

How long does it take, and what does it cost?

Every step is priced on its own. The AI Use Policy Kit is $500. The In-Office AI Policy Workshop is $1,500 in Miami-Dade and Broward. The Governance Install starts at $12,500 and takes three to four weeks to a ratified Charter. A Fractional Chief AI Officer retainer starts at $4,000 a month for firms that want senior AI leadership every month.

Does this replace our CCO or outside compliance consultant?

No. Your CCO owns your compliance program, and that does not change. We bring the AI side: which tools staff use, where client data goes, how outputs are checked, and how the records are kept. Your CCO or counsel reviews and approves the policy before your principal signs it. Nothing we deliver is legal or compliance advice.

Do family offices need an AI policy if they are not SEC registered?

Usually yes, for a different reason. A single family office that fits the SEC family office rule may not be a registered adviser, but it still holds the most private data a family has. The policy protects confidentiality, sets who may use AI on family matters, and keeps a record of what AI was used for. We deliver in English and Spanish.
